- "Agreement" — these Terms and Conditions, together with any written engagement letter or fee agreement entered into between Thayat and a client.
- "Engagement" — a formal legal services engagement accepted in writing by Thayat.
2. Acceptance of Terms
By accessing our Website or enquiring about our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Website or contact us for services.
Our Services are available only to individuals who are 18 years of age or older and who have full legal capacity to enter into a binding agreement. By engaging our Services, you confirm that you meet these requirements.
Formal engagement of our Services is not formed through website use alone — it requires a signed written engagement letter or fee agreement between you and Thayat.
3. Description of Services
Thayat provides legal services related to inheritance and succession matters in Thailand, including:
- Will drafting and review
- Heir identification and family mediation
- Estate administration support
Our Services are delivered from our office in Bangkok and may extend to coordination with government offices, courts, and other relevant authorities within Thailand. We do not provide legal advice on matters governed by the laws of jurisdictions outside Thailand, though we may assist in coordinating with local advisors in such jurisdictions where relevant to your case.
4. Website Use
You may use our Website for lawful purposes only. You agree not to:
- Use the Website in any way that breaches applicable law or regulation
- Transmit unsolicited communications or spam
- Attempt to gain unauthorised access to any part of the Website

5. Client Responsibilities

- Pay agreed fees in accordance with the written fee agreement

6. Fees and Payment
Our published starting fees are indicative. Final fees depend on the complexity of your matter and are confirmed in a written fee agreement before any work begins. By signing the fee agreement, you authorise us to proceed on the basis of the agreed terms.
Fees are denominated in Thai Baht (THB). Payment terms are as specified in your engagement letter. We reserve the right to suspend work if agreed payment terms are not met.
Fees paid for work already completed are non-refundable. If a matter is discontinued before completion, fees for work done to the point of discontinuation will be charged.
7. Service-Specific Terms
Will Drafting & Review: We will prepare or review a will based on instructions provided by you. You are responsible for ensuring instructions reflect your genuine wishes. We cannot be responsible for changes in circumstances after a will is executed that are not communicated to us.
Heir Identification & Mediation: Our mediation service is conducted on a neutral basis. We do not advocate for any individual party. Any agreement reached through mediation is between the parties and we are not responsible for its enforcement.
Estate Administration: We will coordinate the administrative steps of estate administration on behalf of the estate administrator. Timelines are subject to court and government office processing times, which are beyond our control.
8. Intellectual Property
All content on the Thayat Website, including text, design, and structure, is the property of Thayat. You may not reproduce, distribute, or use it for commercial purposes without written permission.
Documents prepared by us on your behalf are provided for your use in the relevant legal matter. You may not distribute legal documents prepared by us to third parties without our prior consent, except as required by law or court process.
9. Disclaimers
Information on our Website is provided in good faith but may not always be current. It does not constitute legal advice and should not be relied upon as such without consultation with a qualified practitioner.
We do not make assurances as to particular outcomes of legal matters. Inheritance law involves human, administrative, and judicial variables that are beyond any practitioner's control.
10. Limitation of Liability
To the extent permitted by law, Thayat's liability for any claim arising from the provision of Services is limited to the fees paid for the specific service to which the claim relates.
We are not liable for indirect losses, delays caused by third parties (including courts and government offices), or outcomes of matters that arise from information you have not provided to us.
11. Termination
Either party may end an engagement by written notice. Upon termination:
- You remain responsible for fees for work completed to the date of termination
- We will return original documents you have provided
- Provisions relating to confidentiality, intellectual property, and dispute resolution survive termination
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Kingdom of Thailand. Any disputes arising from or relating to these Terms or the provision of our Services shall be subject to the jurisdiction of the courts of Thailand.

13. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with a revised date. Continued use of our Website after changes are posted constitutes acceptance. We will inform active clients of any material changes directly.
